1. Conclusion of contract
You are concluding a contract with XP Card Technologies Ltd (“XP Card”).The presentation of our products represents merely a non-binding offering of items that you might wish to purchase from us. By clicking the “Buy now” button, you enter into a binding agreement to purchase the items in your shopping basket. An order confirmation will be emailed to you when you have submitted your order. This confirmation represents merely acknowledgement of the receipt of your order and does not constitute a legally binding acceptance of your order. The actual sales contract between XP Card and you comes into effect when we accept your order - at the latest on delivery of the items in question. Orders are delivered exclusively to end customers.Stated prices include the applicable statutory VAT. Items remain the property of XP Card until paid in full.If the items are not available through no fault of our own, we have no obligation to supply if we ourselves have not been supplied punctually or at all despite undertaking normal and appropriate transactions to ensure our sources of supply, and have informed you of this in a timely manner. In such cases, we will immediately refund any deducted points and credit them to your account; any EUR payments made by you will be refunded immediately.We will save your order details and send them to you by email. You agree herewith to receive invoices by email.
XP Card reserves the right to terminate the contractual relationship with you including but not limited to:
- suspicious account behaviour
- offensive language during communication with staff
- racist, sexist, mysoginistic, violent or otherwise offensive language during the creation of the gamertag
- fraudulent transaction attempts
- failed KYC
2. Delivery and shipping costs
Delivery times may vary for specific items (due to their fragile nature) and, in particular, for items that are included in special offers. In this case, you can find the relevant information on our product and/or promotions page.
3. Payments & point redemption
Orders can be paid for by credit card or redeemed with points. We reserve the right not to make certain payment methods available for your order and to ask you to use a different payment method. You retain the right to demonstrate that no losses have been incurred or are in fact less than this sum. When you redeem your points for rewards available through our app, redeemed points will be automatically deducted from your XP Card account on conclusion of the order process
4. Voluntary right of return service
As an extra service in addition to your statutory right of return, we also extend to you the right to return items ordered from us and purchased with EUR (not points) within 4 weeks of receipt. As regards special offers, we reserve the right to exclude this voluntary right of return for specific items. In this case, you can find the relevant information on our product and/or promotions page. You can exercise this right by simply returning the items within 4 weeks of receipt. You do not need to state a reason for returning the items. The corresponding return period for repeat deliveries of similar goods commences on receipt of the first partial delivery. However, please note that our acceptance of returned items is conditional on these being complete, unused and undamaged and returned in the original packaging. We thus reserve the right to undertake a normal inspection to verify the properties, condition and functionality of the items in question. You can also declare your wish to return items by contacting us at cs@xpcard.proIn order to meet the return deadline, the items must be dispatched back to us or a request for collection made by the last day of the return period.This right of return does not apply to: a) Items that are custom-made or feature customer specifications designed to suit your requirements; b) game keys and giftcard codes that have been activated; c) event tickets or vouchers . This right to return does not apply to services to be provided on fixed dates..dispatched from outside our delivery area are to be borne by the purchaser.
We will reimburse without delay payments made by you for returned items including shipping and delivery costs (with the exception of additional costs incurred because you selected a delivery method other than the most cost-effective standard delivery method we offered you) or at the latest within 14 days of receipt of the returned items. The return period for items that cannot be dispatched by parcel post and items returned from abroad begins on the day we receive your return request. Unless expressly agreed otherwise with you, refunds will be made employing the same payment method you used to pay for the original transaction; under no circumstances will you be charged in connection with a refund.
5. Statutory liability for defects and warranties
The statutory liability in the case of defects applies. In the event of the presence of unexpected defects, you may also be entitled to compensation under the manufacturer’s warranty in addition to your statutory rights in this instance. Even if a manufacturer’s warranty is specified as part of the item description, this will have no effect on your statutory rights in the event of defects. 6. Applicable law and place of jurisdiction
Cyprus law shall apply to any bilateral commercial transactions; excluded shall be the provisions of the UN Convention on Contracts for the International Sale of Goods.
7. Arbitration proceedings
